Having a Lasting Power of Attorney (LPA) in place is incredibly important for ensuring that your wishes are respected if you become mentally or physically incapable of making decisions. Martin Lewis, the money expert and consumer champion, has been particularly vocal in encouraging people to get an LPA set up so they can be sure that their wishes will be followed in the event of an illness or injury.

At Soteria Planning, we provide estate planning services that include setting up LPAs for our clients across England and Wales. Setting up an LPA is simple and affordable but it comes with a range of benefits that will ensure your loved ones are taken care of if you become unable to make decisions. LPAs are also a planning tool used by business owners, which can allow for a smooth transition of power and ownership without legal complications should the business owner or key decision maker become incapacitated. It means that wages can still be paid, bills don’t mount up and the business would essentially continue as normal.

An LPA is a legal document that lets you appoint people (known as attorneys) to help make decisions or take actions on your behalf. There are two types of LPAs – property and financial affairs, and health and welfare – which cover different areas of decision-making. Property and financial affairs will let your attorney manage all aspects of your finances, such as paying bills, selling property and managing bank accounts. Health and welfare LPAs will allow them to make decisions about things like where you live, what medical treatment you should receive, whether to consent or refuse medical care and even life-sustaining treatments.

To be legally valid, an LPA must be registered with the Office of the Public Guardian. It is important to ensure that all relevant information is included in the document and that it is filled in correctly. Martin Lewis has long been an advocate of LPAs, as they ensure that your wishes will be respected, and has appeared on TV multiple times to recommend their use and registration. You’ll find videos of him talking on The One Show, on This Morning and on his own show.

Here is a quick link to a tweet he posted this week where he says that LPAs are possibly more important than Wills. They are certainly a useful lifetime planning tool and here at Soteria Planning, we are on hand to help get these documents in place.
